Privacy Statement

General

This privacy statement contains information about the way in which we process personal data as part of our business activities. This includes the processing of data via our websites, including https://www.barkleytyres.com  (including local extensions of these domains). ‘We’ refers to Heuver Tyrewholesale B.V. (“Heuver”). This statement only applies to the Barkley websites.

For the processing of this data Heuver is the controller in the sense of the General Data Protection Regulation (GDPR). We will process your data carefully and in accordance with the applicable privacy legislation, including the GDPR. If you have any questions after reading our privacy statement or more generally or wish to contact us, this can be done using the contact information given at the end of this privacy statement.

Data processing

Heuver processes personal data of (contact persons at) customers, suppliers and other business associates, of job applicants and of website visitors. In most cases we obtain your personal data from you, for example if you enter into a contract with us, if you visit one of our websites or if you complete a form on one of our websites.
Data that we may process includes:

•    basic information such as your first name and surname, gender, the company where you work and your job title;
•    contact details such as (postal) address, (mobile) telephone number, e-mail address 
•    IP address and statistical data about your use of our website;
•    all other personal data that we obtain from or about you and that we use for the purposes listed below.

We do not always process all the data specified above. This depends on the nature of the relationship, the service involved and (where applicable) the permission that you have given us.

Purposes for processing personal data

We process the data specified above for one or more of the following purposes (partly dependent on the relationship with you):

To comply with legal obligations

We process your data insofar as this is necessary in order to comply with legal obligations. For instance in order to provide information to the Tax Administration, investigation agencies and/or regulators.

Use and improvement of our website

We analyse the surfing behaviour of visitors to our website. We do this in order to monitor and improve the content, structure and use of our website.

Other processing

We also process your data in order to deal with any queries or complaints. 

Basis for data processing

We process your personal data on the basis of one or more of the following legal bases:
•    The execution of a contract with you or in order to take steps to enter into a contract;
•    A legitimate interest;
•    Your permission;
•    To comply with a legal obligation.

Provision to third parties

In some cases we will share your personal data. We will only do this if we consider it necessary. We will only share your data with trustworthy parties, and we will ensure that the process of sharing this data is surrounded by appropriate safeguards. Third parties with whom we may share your data are:

•    Government bodies such as the Tax Administration, the Customs Service and regulators.
•    Commercial principals and chain partners such as suppliers, importers, financing companies, shippers, contractors and subcontractors
•    External suppliers such as ICT service providers, hosting and cloud service providers or other suppliers to whom we outsource supporting services.
•    External advisers/service providers such as accountants, insurance companies, tax consultants, banks, employment agencies, bailiffs, attorneys and notaries

If the third party with whom your data is shared it is considered a processor in the sense of the GDPR we will also enter into a processor agreement with this third party.
 

Retention periods

We will retain your personal data in accordance with the GDPR and specific mandatory statutory retention periods. For most data we adopt the statutory retention period of seven years. The data will not be retained for longer than is strictly necessary in order to achieve the purposes for which the data has been collected and in order to comply with legal obligations. Insofar as we wish to retain the data for longer, the data will be anonymised and only used for historical or scientific research or statistical purposes.


Your privacy rights

You have a number of rights under the GDPR. You have the right to ask us for access, rectification, deletion, restriction and portability of your personal data. You also have the right to object to the processing of your personal data. Please contact us if you wish to exercise these rights. Insofar as the processing of your personal data is based on permission, you have the right to retract this permission at any time. 

You also have the right to submit a complaint to the regulating authority: the Dutch Data Protection Authority (Autoriteit Persoonsgegevens)(‘Dutch DPA’). Naturally we would prefer it if you contact us first so we can try and find a solution together.

Data security

We take appropriate security measures in order to prevent misuse of and unauthorised access to personal data. Hence we ensure that only the necessary persons have access to the data, that access to the data is restricted and takes place over secure connections and that our security measures are regularly checked.

Cookies

We use cookies and/or comparable technology on our website. A cookie is a small file that is saved on the device (computer, tablet or smartphone) on which you visit our website. We only use functional cookies and analytical cookies. 

The functional cookies that we use are necessary for the technical working of the website and your user convenience. They ensure that the website works properly and remember your preference settings, for example. They also enable us to optimise our website. With our functional cookies we guarantee that our website works correctly. 

We use analytical cookies to collect statistical data at a privacy-friendly aggregated level about the use of our website so that we can improve our service provision. The analytical cookies that we use come from Google Analytics, and we use them to gain insight into aspects including visitor streams, traffic sources and page displays on our website. We do this in a way that protects your privacy as much as possible. For example, your IP address is only partly saved for this reason. We have entered into a processor agreement with Google which includes agreements about the protection of your personal data.

We may amend this privacy statement from time to time. Changes will be published on our website. We therefore recommend that you review this privacy statement regularly in order to remain informed about changes.
